These Terms of Use ("Terms") form a binding agreement between you and SkyPath ("SkyPath", "we", "us", or "our") and govern your use of the SkyPath VPN Android application (the "App") and the website at skypath.cloud (the "Website", together the "Service"). By downloading, installing, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. The Service

SkyPath provides a virtual private network (VPN) that encrypts your internet connection and routes it through a server of your (or our auto-selection's) choice, to enhance your privacy, security, and ability to access content.

SkyPath is currently offered as a free service. We may introduce optional paid features in the future. Any such feature will be clearly labeled and will not charge you without your explicit consent.

2. Eligibility

You must be at least 13 years old (or the minimum age in your country of residence — for example, 16 in some EU member states) to use SkyPath. If you are under 18 you should review these Terms with a parent or legal guardian. By using the Service you represent that you meet these age requirements and that you have the legal capacity to accept these Terms.

3. Distribution Through Google Play

The App is distributed through the Google Play Store. When you download the App from Google Play, your use is also subject to the Google Play Terms of Service. These Terms govern the relationship between you and SkyPath as the developer of the App. Google is not a party to these Terms and is not responsible for the App.

4. License

Subject to your compliance with these Terms, SkyPath grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on Android devices that you own or control, solely for your personal, non-commercial use.

The App is licensed, not sold. All rights not expressly granted to you are reserved by SkyPath and its licensors.

7. Third-Party Services and Open-Source Components

The App and Service use third-party services and libraries, including (without limitation) Google Firebase Crashlytics, Google Firebase Analytics, Google Play Services, and the open-source WireGuard protocol. Your use of those components is subject to their respective terms and privacy notices. SkyPath is not responsible for third-party services except as set out in our Privacy Policy.

Open-source components included in the App are licensed under their own terms (for example, WireGuard is available under GPL v2 and related licenses; the wireguard-android library is licensed under Apache 2.0). Nothing in these Terms limits your rights under those open-source licenses.

8. Export Controls

The App includes cryptographic software and may be subject to export-control laws of the country from which you access it, including U.S. Export Administration Regulations. You represent that you are not located in a country subject to a comprehensive U.S. embargo and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree not to use or export the App in violation of applicable export-control law.

9. Intellectual Property

All content, code, designs, graphics, logos, and trademarks associated with the Service are owned by SkyPath or its licensors and are protected by copyright, trademark, and other laws. The license in Section 4 does not transfer any ownership to you. Feedback or suggestions you send us are not confidential, and you grant us a worldwide, royalty-free right to use them to improve the Service.

10. Copyright (DMCA)

We respect the intellectual-property rights of others. If you believe material accessible through the Service infringes your copyright, please send a notice to support@skypath.cloud with: (a) your contact information; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it is located; (d) a statement, under penalty of perjury, that the use is not authorized; and (e) your physical or electronic signature.

Because SkyPath does not host end-user content — it only provides an encrypted tunnel — we may have limited ability to act on copyright complaints directed at third-party websites.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including (without limitation) warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, or accuracy.

We do not warrant that the Service will meet your requirements, will be uninterrupted, secure, free of viruses or other harmful components, or that any errors will be corrected. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to you only to the extent permitted.

12. Limitation of Liability

To the maximum extent permitted by applicable law, neither SkyPath nor its affiliates, officers, employees, agents, or licensors shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) loss of profits, revenue, goodwill, data, or use, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising out of or relating to these Terms or the Service, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the total amount you have paid to us for the Service in the twelve (12) months preceding the claim, or (b) ten U.S. dollars (US$10).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest amount allowed by law. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence or for fraud.

13. Indemnification

You agree to defend, indemnify, and hold harmless SkyPath, its affiliates, and its personnel from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of a third party.

14. Termination

You may stop using SkyPath at any time by uninstalling the App. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required to comply with the law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 4, 9–13, 15, and 16) will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where practical, notify you through the App or the Website before the change takes effect. Your continued use of the Service after changes are posted means you accept the updated Terms. If you do not agree with a change, please stop using the Service.

16. Governing Law and Disputes

These Terms and any dispute arising out of or in connection with them or the Service shall be governed by the laws applicable at SkyPath's principal place of business, without regard to conflict-of-law principles. The courts of that jurisdiction shall have non-exclusive jurisdiction, except that either party may seek injunctive relief in any competent court to protect its intellectual-property or confidentiality rights. Nothing in this Section limits any mandatory consumer-protection rights you have under the law of your country of residence.

17. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable; the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and SkyPath regarding the Service and supersede any prior agreements.
